Authority to Act

Police officers ranked sub-inspector or higher are authorized to take action if they are satisfied that a copyright infringement offence (under Section 63) has occurred, is occurring, or is likely to occur.

Seizure without Warrant

Officers may seize all infringing copies and manufacturing plates without a warrant, regardless of where they are found.

Magistrate reporting

All seized items must be produced before a Magistrate as soon as practicable.

Any person claiming an interest in the seized materials may apply to the Magistrate for their restoration within 15 days of the seizure.

Judicial Inquiry

The Magistrate will conduct an inquiry, hear both the applicant and the complainant, and issue a final order regarding the application.
